End-User License Agreement (EULA)

This End-User License Agreement ("Agreement") is between FasTrak Insurance Solutions Inc. d/b/a BrokerIQ ("Licensor") and you ("User"). By accessing or using BrokerIQ, you agree to this Agreement.

1. License Grant

We grant you a limited, non-exclusive, non-transferable license to access and use the BrokerIQ platform for your internal business operations in connection with insurance agency management.

2. Restrictions

You may not sublicense, sell, or redistribute BrokerIQ
You may not reverse engineer, decompile, or disassemble the platform
You may not use the platform for unlawful purposes
You may not attempt to gain unauthorized access to other users' data

3. Third-Party Integrations

BrokerIQ connects with third-party services (Intuit QuickBooks, Microsoft 365, Dropbox Sign, IVANS, and others). Your use of those services is subject to their respective terms of service. We are not responsible for third-party service availability or data handling beyond our platform.

4. Data Ownership

You retain ownership of all data you enter into BrokerIQ. We do not claim ownership of your client records, transactions, documents, or other business data. You may export or request deletion of your data at any time.

5. Service Availability

We strive to maintain platform availability but do not guarantee uninterrupted access. Planned maintenance and updates may require temporary downtime.

6. Limitation of Liability

BrokerIQ is provided "as is." To the maximum extent permitted by law, we disclaim all warranties and shall not be liable for indirect, incidental, or consequential damages arising from use of the platform.

7. Termination

Either party may terminate this Agreement at any time. Upon termination, your access to BrokerIQ will cease, and you may request export of your data within 30 days.

8. Governing Law

This Agreement is governed by the laws of the State of California.
